Regulatory Alerts Item - Small Business Timber Sale Set-Aside Program Share Recomputation

The Forest Service proposes to remove structural change recomputation direction contained in Forest Service Sale Preparation Handbook(FSH) 2409.18 (applicable in Forest Service Regions 1 through 6 only) as one of the means of recomputing timber sale set-aside market share allocation to small business mills within a market area. This change is necessary to make the recomputation process as accurate as possible by making market shares more reflective of current market conditions. Comments are due by December 11, 2006.

Regulatory Alerts Item - PHMSA Seeks Comments on Revisions of Requirements for Security Plans

On September 21, 2006, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published an advance notice of proposed rulemaking (ANPRM) announcing plans to consider revisions to the list of hazardous materials that require development and implementation of a security plan. PHMSA has received two petitions requesting review of current Hazardous Materials Regulations (HMR) security plan requirements. Proposed revisions will address the outstanding petitions. PHMSA will coordinate the rulemaking with the Transportation Security Administration, and other DOT agencies including the Federal Aviation Administration, Federal Railroad Administration, and the Federal Motor Carrier Safety Administration. Written comments must be received by December 20, 2006. Also, on November 30, 2006, PHMSA will host a public meeting to obtain comments and recommendations on security plan requirements. The meeting will begin at 9:00 a.m. at the U.S. Department of Transportation, Nassif Building, Room 2230, 400 Seventh Street, S.W., Washington, DC 20590-0001.
